1. Acceptance of Terms

Welcome to DomeBase. These Terms of Service ("Terms") govern your access to and use of the DomeBase website located at domebase.io (the "Site"), including any content, functionality, and services offered on or through the Site.

By accessing or using the Site, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Site.

2. Description of Service

DomeBase is developing immersive entertainment venues that bring stadium-like experiences to local communities. Our current services include:

  • Waitlist Registration: Sign up to be notified when DomeBase launches in your area
  • Founder Pass Reservations: Reserve your spot to purchase a Founder Pass when available
  • Informational Content: Learn about DomeBase experiences and offerings

Our services are currently in development, and availability may vary by location.

3. Eligibility

You must be at least 18 years old to use our Site and services. By using the Site, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You are not prohibited from using the Site under applicable laws
  • All information you provide is accurate and complete

4. Waitlist and Founder Pass

4.1 Waitlist Registration

By joining our waitlist, you:

  • Agree to receive communications about DomeBase launches and updates
  • Understand that waitlist registration does not guarantee access to services
  • Acknowledge that launch dates and locations are subject to change

4.2 Founder Pass

The Founder Pass is a one-time purchase that provides lifetime benefits, including:

  • 50% discount on all ticket purchases
  • Priority access to ticket sales
  • VIP seating priority
  • Exclusive Founder events
  • Founder Wall recognition

Founder Pass terms:

  • Price: $100 one-time payment (non-refundable once venue opens)
  • Availability: Limited to 100 passes per city
  • Transferability: Founder Passes are non-transferable
  • Validity: Valid at the designated DomeBase location only

4.3 Refund Policy

Founder Pass purchases may be refunded in full if:

  • DomeBase does not open in your registered city within 24 months of purchase
  • You request a refund before the venue officially opens

Once the venue opens, Founder Pass purchases are non-refundable.

5. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose
  • Provide false or misleading information
  • Interfere with or disrupt the Site or servers
  • Attempt to gain unauthorized access to any part of the Site
  • Use automated systems to access the Site without permission
  • Transmit viruses, malware, or other harmful code
  • Violate any applicable laws or regulations
  • Infringe on the rights of others

6. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, audio, video, and software, is the property of DomeBase or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, reproduce, or distribute any content without permission
  • Modify or create derivative works from the content
  • Use the DomeBase name, logo, or trademarks without authorization
  • Remove any copyright or proprietary notices

7. Third-Party Content and Links

The Site may contain links to third-party websites or services. We are not responsible for:

  • The content or accuracy of third-party sites
  • The privacy practices of third-party sites
  • Any damages resulting from your use of third-party sites

8. Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, DOMEBASE DISCLAIMS ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF CONTENT
  • UNINTERRUPTED OR ERROR-FREE OPERATION

We do not guarantee that:

  • DomeBase will launch in your area
  • Specific events or experiences will be available
  • The Site will always be available or secure

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOMEBASE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, DATA, OR GOODWILL
  • ANY DAMAGES EXCEEDING THE AMOUNT YOU PAID TO DOMEBASE IN THE PAST 12 MONTHS

This limitation applies regardless of the theory of liability (contract, tort, or otherwise).

10. Indemnification

You agree to indemnify, defend, and hold harmless DomeBase and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Site or services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit or transmit through the Site

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on the Site
  • Updating the "Last Updated" date
  • Sending an email to registered users (for significant changes)

Your continued use of the Site after changes constitutes acceptance of the modified Terms.

Upon termination, your right to use the Site ceases immediately.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DomeBase regarding your use of the Site and supersede all prior agreements and understandings.
